By accessing or using SmartCV.chat ("Service"), you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service

SmartCV is an AI-powered career agent platform that allows users to create, manage, and share professional profiles with recruiters. We act as a tool to facilitate connections but do not act as an employment agency.

3. User Accounts

• You must register for an account to access most features of the Service.
• You are responsible for maintaining the confidentiality of your account and password.
• You agree to accept responsibility for all activities that occur under your account.
• We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.

4. Content Ownership and Responsibility

You retain all rights to the resumes, CVs, and other content ("User Content") you upload. By uploading User Content, you grant SmartCV a non-exclusive, worldwide, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content solely for the purpose of providing and improving the Service.

You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to your User Content and that such User Content does not infringe any third-party rights.

5. Subscription and Payment

• Billing: Certain features of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (e.g., monthly).
• Changes: We reserve the right to modify pricing at any time. Any price changes will take effect at the start of the next billing cycle following notice to you.
• Cancellation: You may cancel your Subscription at any time through your account settings. Your cancellation will take effect at the end of the current paid term.
• Refunds: All fees are non-refundable except as required by law or solely at our discretion.

6. Prohibited Uses

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation.
• To exploit, harm, or attempt to exploit or harm minors in any way.
• To transmit any unsolicited or unauthorized advertising or promotional material.
• To impersonate or attempt to impersonate SmartCV, a SmartCV employee, another user, or any other person or entity.

7. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8. Limitation of Liability

In no event shall SmartCV, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.
